Terms and Conditions

These terms and conditions form the basis on which you can visit us and our website.  Please read them carefully as they contain important information.

  2. SUMMARY OF YOUR KEY RIGHTS
    2.1. The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that up to 14 days after receiving your goods, in most cases, you can change your mind and get a full refund. The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. This is a summary of some of your key rights. It is not intended to replace the contract below which you should read carefully
  3. PLACING AN ORDER
    3.1. When placing an order, you undertake that any and all information given is accurate and complete. To amend an order or delivery address, please contact us immediately.  We will do our best to make amendments prior to despatch, but we cannot guarantee changes can be made once an order is processed.  All orders are subject to acceptance and product availability.  Availability information for products is listed on each individual product description.
    3.2.   Once you have placed an order, we will send you an email confirming that your order has been received, but this is not a confirmation that your offer to purchase the goods has been accepted.  For the avoidance of doubt, this correspondence does not constitute a contract between us. A contract between you and e-pots will only exist once an order has been despatched to you.
    3.3.   If for any reason we are unable to fulfil any part of the order, we will notify you as soon as is practical and refund your card within seven days of so doing.  This does not affect your statutory rights.  Prices and availability of goods are subject to change without notice. The advertised delivery charge will be added to your order value unless otherwise stated.
  4. PAYMENT TERMS
    4.1.   We will take payment upon receipt of your order from your credit or debit card. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from you, then we can refuse to process your order and/or suspend any further deliveries to you. This does not affect any other rights we may have.
    4.2.   The prices payable for goods that you order are as set out on our website. All prices are inclusive of VAT at the current rates and are correct at the time of entering information.
    4.3.   Where it is not possible to accept your order to buy goods of the specification and description at the price indicated, we will advise you by email, and offer to sell you the goods of the specification and description at the price stated in the email and will state in the email the period for which the offer or the price remains valid.
  5. SPECIAL OFFERS AND PROMOTIONS
    5.1. Unless otherwise stated, special offers cannot be used in conjunction with any other promotion nor are they valid for the purchase of sale items or gift vouchers.
    5.2.  Use of coupons:-
    A coupon code is valid for a limited time only and expires on the date specified in the promotional materials.
    A coupon code may only be used once per customer unless otherwise stated in the promotion.
    A coupon code may not be combined with any other offers,sales or discounts.
    A coupon code is not redeemable for cash.
    Only one coupon code may be used per transaction.
    A coupon code is not valid on previous purchases.
    A coupon code is not transferable.
    A coupon code is void where prohibited by law.
    Any taxes and shipping and handling charges are not included in the discount and are the responsibility of the customer.
    The company reserves the right to cancel or modify the coupon code promotion at any time without notice.
  6. OWNERSHIP OF RIGHTS
    6.1. All rights, including copyright, in this website are owned by Geo Emporium Ltd and licensed to e-pots.co.uk. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.
  7. ACCURACY OF CONTENT
    7.1. We have taken care in the preparation of the content of this website, to ensure that prices quoted are correct at the time of publishing and that all goods have been described accurately. Any weights, dimensions and capacities given about the goods are approximate only.
  8. DAMAGE TO YOUR TECHNICAL DEVICES
    8.1. We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
  9. DELIVERY
    9.1. Stock permitting, all orders are usually despatched within two working days of the order being received. If an item is temporarily out of stock, we will notify you of the delay and despatch it as soon as it arrives.
    9.2.  The delivery period stated within which you will receive your order is indicative and, unless otherwise stated, not guaranteed.  Goods will be sent to the address given by you in your order.  If you are ordering more than one item, your goods may be sent to you in instalments if certain items are out of stock. In this case, you will only pay a single delivery charge. If your delivery address is outside of the UK, you may be subject to import duties and taxes, which are levied once a shipment reaches your country.  You must meet any additional charges for customs clearance.  Please note, customs policies vary widely from country to country.  We recommend you contact your local customs office for further information. Please note international shipments may be subject to cross border inspections by customs authorities. Delivery will be completed when we deliver the Products to the delivery address given in the order.
    9.3.   The Products will be your responsibility from the completion of delivery.  You own the Products once we have received payment in full, including all applicable delivery charges. We deliver to destinations inside UK. However there are restrictions on some Products for certain countries for further information please visit http://www.parcelforce.com
  10. RETURNS AND REFUNDS
    10.1. Please take good reasonable care of the goods. We are entitled to deduct an amount from the refund to reflect any loss in value of the goods supplied, if the loss is the result of unnecessary handling of the goods by you.  Please make it clear when you cancel that you are cancelling under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations.
    10.2.   WHAT SHOULD I DO IF I RECEIVE AN INCORRECT ITEM?
    We have high standards when it comes to packaging your order however mistakes do occur from time to time as we are human. Please accept our apologies if you have received an incorrect item.
    10.3.   As part of our customer objectives, we will do our utmost to resolve your query with speed, ease and with absolute minimal inconvenience. We will review each case individually when considering the return of the product.  In some cases we may require further information such as pictures so we can choose the best course of action.   Our aim is to provide the best solution for you as quickly as possible.
    10.4.   WHAT SHOULD I DO IF MY ITEM ARRIVES DAMAGED?
    Although we take care to prevent any damage to your goods during transit it is possible that problems may arise. Please accept our apologies if you have received a damaged item.  We ask that you do not refuse delivery, instead accept the goods and contact us immediately. Refusal may actually result in a delay of the parcel being returned.  You can contact us by email to hello@e-pots.co.uk. Please attach any pictures you have of the damage to the message. A member of our team will review the details and offer the best resolution to resolve your query.
    10.5.   HOW DO I REPORT A FAULT WITH MY PRODUCT?
    Please accept our apologies if you believe there is a fault with your item, we take all complaints regarding the quality of our products seriously and we will need to investigate the reported fault in more detail. Please contact us at hello@e-pots.co.uk
    10.6.   HOW DO I ARRANGE A RETURN?
    Please contact our Customer Service team to arrange your return via hello@e-pots.co.uk.  We will need to know your order number, the item you want to return and the reason for return. Upon receipt of these details we will provide you with the necessary information to arrange the return.  Please package the item securely.  You will need to obtain a proof of postage receipt when you send your item to us. Proof of postage does not cost anything but without it we may not be able to process your refund or replacement in the rare event that your item is lost in transit. If you request a replacement and the product is no longer available, we will process a refund back to the original account used to purchase the item.   Any item you have accepted and then returned is your responsibility until it reaches our warehouse. Please therefore ensure that you send your item back to us using a delivery service that insures you for the value of the goods.
    10.7.   WILL YOU REFUND MY POSTAGE COST TO RETURN AN ITEM?
    We are more than happy to refund postage costs to return an item where the return is required due to our error. For instance:  If we sent you the wrong item or if the item is damaged or faulty.
    10.8.    Where you are returning a substitute item which you do not want to keep, we will not refund postage costs to return items which are unwanted or no longer required. These costs will need to be covered by you, again we recommend using a delivery service that insures you for the value of the goods.  We will not refund postage costs to return any item due to reported damage or fault where no error was found in the testing process.
  11. RIGHT TO CANCEL
    11.1. You have the right to cancel this contract within 14 days without giving reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires physical possession of the goods.  To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement (e.g. by emailing hello@e-pots.co.uk. Please ensure that the items you are returning are unopened and in any original packaging. Unwanted goods need to be in pristine condition with any retail seals unbroken.
    11.2.   Effects of Cancellation – If you cancel this contract, we will reimburse to you all payments received from you, including the cost of delivery (except for supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).  We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you.
    11.3.   We will make the reimbursement without undue delay and not later than:
    (a)    14 days after the day we receive back from you any goods supplied; or
    (b)    (if earlier) 14 days after the day you provide evidence that you have returned the goods; or
    (c)    if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel the contract.
    11.4.   We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement. You will have to bear the direct cost of returning the goods.
  12. CANCELLATION BY US
    12.1. We reserve the right not to process your order if:
    We have insufficient stock to deliver the goods you have ordered
    We do not deliver to your area; or
    One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
    If we do not process your order for the above reasons, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit/debit card as soon as possible, but in any event within 14 days.
  13. PRIVACY
    13.1. You acknowledge and agree to be bound by the terms of our privacy policy. Available here
    13.2. Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.
  14. THIRD PARTY RIGHTS
    14.1 Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
  15. LAW & TERRITORY
    15.1. These terms and conditions and your use of our website are governed by English law and you agree to submit to the exclusive jurisdiction of the English courts.  This does not affect your non excludable statutory rights.
    15.2.   This website and our terms and conditions have been designed for use within the United Kingdom and under the laws of England. Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that the use of this website or the placing of any order through this website from outside the UK complies with any applicable  laws or regulations other than the laws of England.  Accordingly, any products or promotions not permitted under your local law are not offered to you.
    15.3.   All contracts are concluded in English.
  16. LIABILITY
    16.1. Unless agreed otherwise, if you do not receive goods ordered by you within 30 days of the date on which you ordered them and decide to cancel the order rather than re-arrange delivery (in accordance with clause 11), we will provide you with a full refund.
    16.2.   We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions.  We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) does or fails to do, or is due to events which are beyond our reasonable control.
    16.3.   Furthermore, we do not accept liability for any losses related to any business of yours including but not limited to: lost data, lost profits, crop yield, lost revenues or business interruption.
    16.4.   You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site.  The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
    16.5.   Due to the natural nature of the products and properties, there can be slight variation of the product specifications.
    16.6.  Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.   You have certain rights as a consumer including legal rights (e.g. under the Act) relating to faulty and/or misdescribed goods.
